Special Issue Information

Dear Colleagues,

Land law is shaped by economic, social, and political policy goals. The role that policy places in our understanding and formulation of doctrinal legal principles is often underplayed in the existing academic literature and in pedagogical methods. This comes at a time when land law is increasingly being expected to play an instrumental role in shaping societal and family relationships and regulate our development and enjoyment of the urban landscape in response to environmental challenges.

The aim of this special issue is to showcase particular aspects of land law, in England and Wales and in other common law jurisdictions internationally, to identify the policy factors that influence this part of private law, and to highlight how an appreciation of these factors can better inform our understanding of underlying principles, doctrinal frameworks, and proposals for reform.

The Special Issue will concentrate on private law aspects of land law. As well as doctrinal, theoretical, and socio-legal methods, different approaches and methods are invited. Contributions are encouraged in the areas of (but not limited to) strata title and leasehold reform, land registration, family property, mortgages and mortgage regulation, property development, and the environment. Articles which have a jurisdiction other than England and Wales as their focus or which adopt a comparative analysis are welcomed.
