This work is a reexamination of the historic economic rights debate in light of two major changes in American public policy. The first change considers the effect of the debate by the passing of the Affordable Care Act (Obamacare). The second policy change considers how the debate should include the effects of the economic bailout brought about by the TARP program. These changes are explained first, as government interventions made in response to widespread suffering and medical cost bankruptcies due to the United States’ healthcare system having no guaranteed right to healthcare. The second change focuses on the necessity of a national economic bailout conducted in response to a “Great Recession,” as an historic proof that government must intervene when severe economic downturns threaten to collapse the national economy. These interventions support the passage of economic rights and show how the opposition to the passage of economic rights have been based on faulty moral argumentation and reasoning. The essay concludes with a continued call for the passage of the International Covenant on Economic, Social, and Cultural Rights. Full article

Designing Work with People Living with Dementia: Reflecting on a Decade of Research

The United Nations Universal Declaration of Human Rights is widely acknowledged as a landmark document in the history of human rights. Drafted by representatives from all over the world, the declaration was proclaimed by the United Nations General Assembly in Paris on 10 December 1948 (General Assembly resolution 217 A) as a common standard for all peoples and all nations. The declaration sets out a series of articles that articulate a number of fundamental human rights to be universally protected. Article 23 of the declaration relates to the right to work and states that people have a human right to work, or engage in productive employment, and may not be prevented from doing so. The right to work is enshrined in international human rights law through its inclusion in the International Covenant on Economic, Social and Cultural Rights, where the right to work emphasizes economic, social and cultural development. This paper presents ongoing research that highlights how a disruptive co-design approach contributes to upholding UN Article 23 through the creation of a series of innovative working practices developed with people living with dementia. The research, undertaken in collaboration with several voluntary and third sector organizations in the UK, looks to break the cycle of prevailing opinions, traditional mindsets, and ways-of-doing that tend to remain uncontested in the health and social care of people living with dementia. As a result, this research has produced a series of innovative work opportunities for people living with dementia and their formal and informal carers that change the perception of dementia by showing that people living with dementia are capable of designing and making desirable products and offering much to UK society after diagnosis. In this ongoing research, the right to continue to work for people living with dementia post-diagnosis in creative and innovative ways has clearly helped to reconnect them to other people, helped build their self-esteem, identity and dignity and helped keep the person with dementia connected to their community, thus delaying the need for crisis interventions. This paper reports on a series of future work initiatives for people living with dementia where we have used design as a disruptive force for good to ensure that anyone diagnosed with dementia can exercise their right to work and engage in productive and rewarding employment. This article examines the extent to which the inclusion of the European Union (EU) Charter of Fundamental Rights in the Treaty of Lisbon, which gives legal force to socio-economic rights as well as civil and political rights, will succeed in helping EU member states meet international treaty obligations to implement socio-economic rights. Will the EU’s renewed commitment to developing the social sphere, post-Brexit, be more successful and will British citizens lose out on so-cio-economic rights in the long term if the EU succeeds in creating a better social or public dimension? Member states of the EU that have ratified the International Covenant on Economic, Social and Cultural Rights (ICESCR) have obligations to progressively realise economic, social and cultural (ESC) rights. Progress on this has been slow and potentially made more difficult by the economic direction adopted by the EU since the 1980s. Although the EU, from the beginning, saw itself as a “social market” it struggled to embed the “social” to the same extent that it embedded the “market”. Critics argue that the economic policies of the EU and key judgements of the European Court of Justice (ECJ) successfully dis-embedded the market from its social context. Additionally, the regulatory regime of the EU developed in a direction that limited the capacity of nation states to ameliorate the consequences of market-led policies for the least advantaged. However, the Charter of Rights, which places socio-economic rights on an equal footing with civil and political rights, is a novel and bold initiative. It has stimulated debate on whether the Charter could rebalance the EU’s economic agenda by paying attention to the social consequences of predominantly market-led policies. This paper examines the potential impact of the EU Charter, in the context of member states international human rights obligations, to create an environment where member states of the EU have fewer obstacles to the “progressive realization” of ESC rights. Affordability and Disconnections Challenges in Implementing the Human Right to Water in Portugal

Although the Human Right to Water and Sanitation (HRtWS) has been recognised by the United Nations and several countries have reformed their constitutions and/or national legislation to reflect this decision, several others, namely developed countries, have not reacted domestically to this recognition. The argument usually lies with the high level of institutionalisation of economic, social and cultural rights in these countries. However, reports of water disconnections due to payment default, especially in times of economic crisis and austerity policies, raise the issue of what does the implementation of the HRtW imply in countries where physical accessibility is almost fully guaranteed. The discussion seems to then focus on issues of affordability. This article focuses solely on the dynamics of implementing the Human Right to Water, because once the physical accessibility to sanitation is guaranteed, even if the service is deemed unaffordable and payment default ensues, disconnection of sewage collection per se does not occur. This does not imply that there are no issues associated with sanitation services in Portugal, but that those issues are of a different nature and beyond the scope of this article. Portugal does not have an explicit recognition of the HRtWS in its legal framework, but voted in its favor in the United Nations General Assembly and it is also a party to the International Covenant on Economic, Social and Cultural Rights. Thus, in Portugal, a country with 96% of the population connected to drinking water services, the HRtW is considered a non-issue. The article, however, argues that the HRtW in Portugal is not fully implemented and that issues of affordability hinder its respect, protection and fulfillment. The discussion builds on research conducted after the economic crisis period (2010–2014), since during those challenging years, the country faced a high number of households being deprived of access to water due to payment default. The dynamics of this period show that the core issue underlying the recognition of a HRtW still remains in Portugal. Full article

In light of the recent adoption of the Optional Protocol to the International Covenant on Economic, Social and Cultural Rights (OP-ICESCR) and the Optional Protocol to the Convention on the Rights of Persons with Disabilities (OP-CRPD), there is a necessity for harmonisation among the treaty bodies, particularly in the area of socio-economic rights. The equality norm in the CRPD, including the duty to reasonably accommodate, is an important facilitator of socio-economic rights. This article sets forth the opportunities for cross-fertilisation of socio-economic rights, and disability rights in particular, at the level of international human rights law and beyond, as well as the potential that exists for social change at the domestic level. The CRPD Committee and the United Nations Committee on Economic, Social and Cultural Rights (UNCESCR) will undertake the task of assessing measures adopted by States related to alleged violations under the optional protocols and will determine compliance with treaty obligations under the State reporting procedure. In that regard, a framework of “reasonableness review” is proposed, which could provide the opportunity to merge individual rights’ violations with broader issues of socio-economic inequalities and could also lead to coherent implementation of the normative content of socio-economic rights at the domestic level.
